HAC Minutes-2015-09-16MINUTES SEPTEMBER 16, 2015 HOUSING ADVISORY COMMITTEE REGULAR MEETING A. ORGANIZATION 1. CALL TO ORDER: 1:00 p.m. — City Council Chamber 2. ROLL CALL: Committee Members: Laura Freese, Chair Nancy Campman-Crofts, Vice Chair Joanne Marquez Secretary: Laura Stokes, Housing Coordinator / Assistant Planner Staff Present: Jeff Ballinger, City Attorney 3. PLEDGE OF ALLEGIANCE Committee Member Marquez led the Pledge of Allegiance. Agenda items are presented in the originally agendized format for the benefit of the minutes' reader, but were not necessarily heard in that order. B. ORAL COMMUNICATIONS: Robert Coldren addressed the Commission and provided a letter from Steven Walker, San Juan Capistrano regarding concerns with Brown Act violations at the September 14, 2015, Committee Meeting. Mr. Coldren and the Letter from Mr. Walker specifically identified the item which adopted the Bylaws and a Staff Discussion of the City's Mobile Home Rent Control Municipal Code procedures and protocol as inappropriately noticed. Jeff Ballinger, City Attorney related that the two items identified could be added to the agenda with a two-thirds vote because the need for action came to the attention of the Committee after the agenda was posted. The Committee determined that the finding of a need for immediate action and the finding of a need for action came to the attention of the local agency after the agenda was posted can be made. Vice -Chair Campman-Crofts made a motion, seconded by Committee Member Marquez to add the items Introduction of the Housing Advisory Committee Bylaws and Mobile Home Rent Control Hearing Protocol to the agenda Housing Advisory Committee Minutes September 16, 2015 Page 2 C. SUBSEQUENT NEED ITEMS: 1. Introduction of the Housing Advisory Committee By -Laws (Laura Stokes, Secretary). Laura Stokes, Committee Secretary, made the staff presentation and responded to questions. Jeff Ballinger, City Attorney, also responded to Committee questions, and recommended "pursuant to Title 9, Land Use Code, Section 9- 2.302, Public Meeting Procedures" be stricken from the fourth section of the resolution, and the date September 16, 2015 be added. Committee Member Marquez made a motion, seconded by Vice -Chair Campman-Crofts to adopt a resolution, with the City Attorney's recommended changes, approving the Housing Advisory Committee Bylaws. The motion passed by a 3-0 vote. 2. Mobile Home Rent Control Hearing Protocol (Jeff Ballinger, City Attorney). Jeff Ballinger, City Attorney, made the staff presentation and responded to questions regarding the City's Mobile Home Rent Control Hearing and the general process and protocol of any rent control hearing. D. CONSENT CALENDAR: None. E. PUBLIC HEARINGS: None. F. UNFINISHED BUSINESS: None, G. NEW BUSINESS: 1. Consideration of Rent Control (RC) 15-001, EI Nido Mobile Home Estates, $641 rent increase proposed for each unit of EI Nido Mobile Home Estates, located at 27703 Ortega Highway. (Assessor Parcel Number: 650-621-01)(Petition Filed By: EI Nido Mobile Home Estates Steering Committee)(Project Manager: Laura Stokes, Secretary). Laura Stokes, Committee Secretary, made the staff presentation and responded to questions. Jeff Ballinger, City Attorney, also responded to Committee Housing Advisory Committee Minutes September 16, 2015 Page 3 questions. Robert Coldren, Bruce Stanton, Matt Gaffney, Nicholas Basakis, Mathew McClelland, and Bob Boyer spoke on the item. Committee Member Marquez made a motion, seconded by Vice -Chair Campman-Crofts to recommend support of all findings, conclusions, and recommendations made by the Hearing Officer to the City Council. The motion passed by a 3-0 vote AYES: Chair Freese, Vice -Chair Campman-Crofts, and Marquez NOES: None ABSTAIN: None H. COMMISSIONISTAFF COMMENTS: None. I. ADJOURNMENT: The Committee adjourned to the first meeting in April, 2016, in the City Council Chambers.
