Notice is hereby given that on November 2, 1999, the City Council introduced an
Ordinance entitled:
APPROVING DEVELOPMENT AGREEMENT (NEELY FAMILY TRUST)
AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA,
APPROVING A DEVELOPMENT AGREEMENT WITH THE NEELY FAMILY
TRUST FOR REAL PROPERTY LOCATED ON "MCCRACKEN HILL" AND
MORE PARTICULARLY REFERRED TO AS ASSESSOR'S PARCEL
NUMBERS 675-331-18, -19, AND -20 AND 675-341-6 AND -7
The proposed Ordinance approves the Development Agreement which would
vest development rights to develop the property under the current zoning regulations (Small
Estate District) for a period of 20 years. In return the property owner would save any potential
legal claims against the City for soil slide damages in the area on the property known as the
Avocado Slide." In addition, the property ownerwill grant rights-of-way and rights -of -entry for
roadway, utility and other infrastructure improvements on the property and will grant a right-of-
way for a public street. The Agreement does not commit the City to any specific subdivision
design layout at this time.

in the City Clerk's Department, 32400 Paseo Adelanto, San Juan Capistrano, and/or a copy
may be obtained from that Office at a nominal charge.
